The suit filed by the telecommunications giant MTN against the Nigerian Communications Commission challenging the imposition of over N1 Trillion fine against it, came up today before the Honourable Justice M. Idris of the Federal High Court, Lagos. At the hearing today, Counsel for the respective parties informed the court that although they were ready to proceed with the business of the day, they were aware that their respective clients were in discussions towards having an out of court resolution of the dispute.
MTN’s legal team comprising Chief Wole Olanipekun SAN, Tani Molajo SAN, AB Mahmoud SAN, Dr Gbolahan Elias SAN, Babatunde Fagbohunlu SAN, Prof. Fabian Ajogwu SAN, Dr Dapo Olanipekun SAN, and 12 other lawyers agreed to allow their clients time to progress the amicable discussions.
Similarly, the NCC legal team comprising Mr Yusuf Alli SAN, Prof. Taiwo Osipitan SAN, Paul Usoro SAN, Y. C. Maikyau SAN, K. Eleja SAN and other lawyers indicated that they were not unaware of the moves towards an amicable resolution.
The application by one Mr Tope Alabi to be joined as an interested party alongside NCC, was withdrawn by him and consequently struck out by the Court.Counsel to the Attorney General of the Federation, Mr Dipo Okpeseyi SAN and Dr Muiz Banire SAN, leading a team of lawyers from the Attorney General’s office sought for a time table for filing of written addresses in the interim, which all parties agreed to, and the Court ordered, would be 21 days for the Plaintiff, 14 days for the Defendants and another 7 days for the Plaintiff for replies.
The matter was accordingly adjourned by the Court to March 18, 2016 for a report of settlement or hearing of the case.
